Trademark/Copyright Infringement Policy

At Kwikaweb, we want to help you protect your intellectual property. This policy is designed to assist you in handling trademark and copyright infringement claims and safeguard your legal rights.

Disputes Regarding Domain Names

This policy covers all disputes and violations related to Kwikaweb products and services, excluding domain name disputes.

If you have concerns or disputes regarding a registered domain name, please refer to the Uniform Domain Name Dispute Resolution Policy (UDRP). Any disputes regarding domain name registration should be directed to an ICANN-approved arbitration provider. Disputes concerning .ng domain names should be referred to the Nigeria Internet Registration Association (NIRA) and resolved according to the NIRA Complaints Policy.

Trademark Claims

To report a trademark violation or submit a trademark claim to Kwikaweb, please send an email to abuse@Kwikaweb.com with the subject line “Trademark Claim.” Your email should include the following information:

– Owner’s name, address, email, and phone number
– Trademark certificate or acceptance letter
– Date of first use of the trademark
– Description of how your trademark is being infringed
– Details of the person or entity against whom the claim is made (name, address, email, and phone number)
– Sufficient evidence that the infringing party is a Kwikaweb customer

Upon receiving this information, Kwikaweb will investigate and forward the claim to the alleged infringer. During the investigation, we may temporarily remove the alleged infringing material from our website or take other appropriate actions.

If the claim is legitimate, we may permanently remove, suspend, or deny access to the infringing material. If the claim is unfounded, we will promptly restore access to the allegedly infringing material.

This policy does not supersede the UDPR or the NIRA Complaints Policy, and Kwikaweb and its customers are obligated to abide by these policies in appropriate circumstances.

Copyright Claims

To submit a copyright claim to Kwikaweb, please send an email to abuse@Kwikaweb.com with the subject line “Copyright Claim.” Your email should include the following information:

– Copyrighted work that has been infringed
– Copyright certificate (if registered)
– Description of the material belonging to a Kwikaweb customer that is allegedly infringing
– Owner’s name, address, email, and phone number
– Details of the person or entity against whom the claim is made (name, address, email, and phone number)
– Statement from the copyright owner confirming non-authorization of the copyrighted material’s use

Upon receiving this information, Kwikaweb will investigate and forward the claim to the alleged infringer. During the investigation, we may temporarily remove the alleged infringing material from our website or take other appropriate actions.

If the claim is legitimate, we may permanently remove, suspend, or deny access to the infringing material. If the claim is unfounded, we will promptly restore access to the allegedly infringing material.

Counter Notification Policy

If you believe that a trademark or copyright infringement notice you received is based on a mistake or misidentification of the material, you can challenge it by sending an email to abuse@Kwikaweb.com. Please include the following information:

– Removed or disabled material and its original location
– Statement that the removal or disabling was a mistake or misidentification
– Your name, address, email, and phone number

Upon receiving your Counter Notification, Kwikaweb will provide a copy to the Complaining Party and inform them that the removed material will be replaced or access will be restored within ten (10) business days. Kwikaweb will reinstate the material within fourteen (14) business days, unless the Complaining Party provides notice of filing a court order to restrain the alleged infringer’s activities on Kwikaweb’s system or network.

Continuous Infringement

Kwikaweb may terminate the accounts of customers who continuously violate this policy, infringe copyrighted works, trademarks, or other intellectual property, when deemed appropriate.
